1) Scope

1.1 The following terms and conditions apply to all orders placed through my online shop by consumers and entrepreneurs.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in their commercial or independent professional activity.
The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if I have expressly agreed to them.

1.2 The terms and conditions also apply to contracts for the delivery of vouchers, unless expressly stipulated otherwise.


2) Contractual partner / conclusion of contract

2.1 The purchase contract is concluded with Kleiner Schatz - Schmuckdesign.
By placing the products in the online shop, I am making a binding offer to conclude a contract for these items. The associated product descriptions, however, do not represent a binding offer to conclude a contract, but serve for the submission of a binding offer by the customer.
The customer can initially place these products in the shopping cart without obligation and correct his entries at any time before sending the binding order. The contract is concluded when the customer accepts the offer for the goods in the shopping cart by clicking the order button. Immediately after submitting the order, the customer will receive another confirmation by email.

2.2 I accept the customer's offer
by sending the customer a written order confirmation or an order confirmation in text form (by e-mail), whereby the receipt of the order confirmation by the customer is decisive.

2.3 Orders are processed and contact is usually made by email and automated order processing. The customer must ensure that the e-mail address given by him to process the order is correct, so that the e-mails sent by me can be received at this address. Particularly when using SPAM filters, the customer must ensure that all emails sent by me can be delivered.


3) right of withdrawal

3.1 Consumers have the statutory right of withdrawal, as described in my cancellation policy.


4) Prices and terms of payment

4.1 The prices given are total prices, unless my product description states otherwise (due to the small business status according to § 19 UStG, we do not charge sales tax and therefore do not show this). Any additional delivery and shipping costs that may arise are specified separately in the relevant product description.

4.2 The customer can select the payment option (s) in my online shop.

4.3 If prepayment by bank transfer has been agreed, the payment is due immediately after conclusion of the contract, unless a later due date has been agreed between me and the customer.

4.4 When paying via PayPal, the customer will be redirected to the website of the online provider PayPal during the ordering process. In order to be able to pay the invoice amount via PayPal, the customer must be registered there or first register, legitimize himself with his access data and confirm the payment instruction to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. The customer receives further information during the ordering process. 5) Delivery and shipping conditions

5.1 The delivery of goods takes place on the dispatch route to the delivery address specified by the customer, unless otherwise agreed with me. When processing the transaction, the delivery address given by the customer when processing the order is decisive.

5.2 If the transport company sends the goods back to me, if delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment.

5.3 In the case of self-collection, the customer will first be informed by email that the goods he has ordered are ready for collection. After receiving this email, the customer can collect the goods from me after consultation with me. In this case, no shipping costs will be charged.

5.4 I leave vouchers to the customer as follows:
- by email or
- by post

 

5.5 For deliveries abroad, customs duties, taxes and fees may be incurred, which are not included in the total price shown and must be paid by the recipient.

6) Execution deadline

6.1 The execution period of the contract is three to ten weeks from the time of the complete order, in rare cases longer!


7) Liability for defects (warranty)

7.1 If the purchased item is defective, the provisions of statutory liability for defects apply.

7.2 The following applies to consumers:

If goods are delivered with obvious transport damage, please report such errors to the deliverer as soon as possible and please contact me immediately.

Failure to lodge a complaint or to contact you has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights. But they help me to assert my own claims against the carrier or the transport insurance.

 

7.3. Processing accidents:

Unfortunately, in rare cases the quality of the materials sent in by the customer can be too poor for processing.

Since this unfortunately only becomes apparent after I have started processing, it can happen that your materials (teeth, hair, umbilical cord, etc.) are irreparably destroyed during processing.

Please take note of this.

By submitting your order, you take this risk and waive any replacement services.




8) Guarantee

8.1 The customer is granted a 6 month guarantee on frames, chains and bracelets (except bracelets made of horse hair and gold-plated jewelry parts) from receipt of the goods, provided that damage caused by the customer can be excluded (see "FAQ" - Handling & Care).


9) Special conditions for the processing of goods according to certain specifications of the customer

9.1 If the goods are to be processed according to specific customer specifications, the customer must send me all the materials and content required for processing such as teeth, texts, hair, umbilical cord, etc. immediately and in sufficient quantity and quality after receipt of payment. If the customer does not do so within 14 days, I reserve the right to withhold a cancellation fee of 50% of the purchase price (excluding shipping costs) and to withdraw from the purchase contract.

9.2 I reserve the right to refuse processing orders if the content provided by the customer for this purpose violates legal or official prohibitions or against common decency. This applies in particular to the provision of unconstitutional, racist, xenophobic, discriminatory, offensive, youth-endangering and / or violence-glorifying content.


10) Promotion vouchers

10.1 Vouchers that I issue free of charge as part of promotions with a certain period of validity (hereinafter "promotional vouchers") can only be redeemed in the seller's online shop and only within the specified period.

10.2 Promotion vouchers can only be redeemed by consumers.

10.3 Individual products can be excluded from the voucher campaign, provided that a corresponding restriction results from the content of the campaign voucher.

10.4 Promotion vouchers can only be redeemed before the order process has been completed. Subsequent billing is not possible.

10.5 Only one campaign voucher can be redeemed per order.

10.6 The value of the goods must be at least equal to the amount of the campaign voucher. Any remaining credit will not be refunded by me.

10.7 If the value of the campaign voucher is insufficient to cover the order, one of the other payment methods offered by me can be selected to settle the difference.

10.8 The balance of a campaign voucher is neither paid out in cash nor is interest paid.

10.9 The campaign voucher will not be refunded if the customer returns the goods paid for in whole or in part with the campaign voucher within the scope of his statutory right of withdrawal.

10.10 The campaign voucher is transferable. I can pay the respective owner who redeems the promotional voucher in my online shop with a discharging effect. This does not apply if I have knowledge or grossly negligent ignorance of the non-authorization, the legal incapacity or the lack of authorization to represent the respective owner.


11) Gift Certificates

11.1 Vouchers that can be purchased via my online shop (hereinafter "gift vouchers") can only be redeemed in my online shop, unless otherwise stated in the voucher.

11.2 Gift vouchers and the remaining balance of gift vouchers can be redeemed by the end of the third year after the year in which the voucher was purchased. Remaining credit will be credited to the customer until the expiry date.

11.3 Gift vouchers can only be redeemed before the order process has been completed. Subsequent billing is not possible.

11.4 Several gift vouchers can be redeemed for one order.

11.5 Gift vouchers can only be used for the purchase of goods and not for the purchase of other gift vouchers.

11.6 If the value of the gift voucher is insufficient to cover the order, one of the other payment methods offered by me can be selected to settle the difference.

11.7 The balance of a gift voucher is neither paid out in cash nor is interest paid.

11.8 The gift voucher is transferable. I can pay the respective owner who redeems the gift voucher in the seller's online shop with a discharging effect. This does not apply if I have knowledge or grossly negligent ignorance of the non-authorization, the legal incapacity or the lack of authorization to represent the respective owner.


12) Applicable Law

The law of the Federal Republic of Germany applies to all legal relationships between the parties, excluding the laws on the international purchase of movable goods. In the case of consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.


13) Alternative dispute resolution

13.1 The EU Commission provides a platform for online dispute resolution on the Internet under the following link: https://ec.europa.eu/consumers/odr

This platform serves as a point of contact for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.

13.2 I am neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.


14) Note on saving the contract text

14.1 The text of the contract will be saved by Kleiner Schatz - Schmuckdesign after the contract has been concluded.
For security reasons, the customer cannot access this again via the Internet after the contract has been concluded.
The customer is therefore recommended to keep the contract text sent to him by email.
